These Terms & Conditions govern your access to and use of the tools, agent skills, and services provided by TechBuild ("we," "us," or "our"). By using our website, downloading a skill, signing up for a tool, or making a purchase, you agree to these terms. If you do not agree, please do not use the service.

1. Seller identification

You are contracting with TechBuild, the provider of the DFH tools, agent skills, and related services available on this site. TechBuild is the seller of record for the products and services offered here.

2. Acceptance of terms

By accessing or using the service, you confirm that you have the authority to enter into these terms (either on your own behalf or on behalf of the organization you represent), and you agree to be bound by them. We may update these terms from time to time, and continued use after changes means you accept the revised terms.

3. What we provide

TechBuild builds AI-powered tools and agent skills designed specifically for doors, frames, and hardware (DFH) estimating workflows. These are intended to assist professional estimators, not replace their judgment. You are responsible for reviewing any outputs before using them in a bid, specification, or other business decision.

4. Payments, billing, and subscriptions

For paid skills and services, payment processing is handled by Stripe. Stripe manages payment processing, billing, tax calculation and collection where applicable, and related transaction support for your purchase.

Payment, billing, tax, and refund mechanics are handled in accordance with Stripe's terms and the applicable payment method terms. Please review Stripe's services agreement at https://stripe.com/legal.

5. Acceptable use

You agree to use the service lawfully and appropriately. You may not:

• Use the service for any unlawful, fraudulent, or deceptive purpose.
• Spam, abuse, or harass others through the service.
• Infringe on intellectual property rights or other proprietary rights.
• Interfere with the security or operation of the service, including probing, scraping, or introducing malware.
• Reverse engineer, resell, or redistribute agent skills or tools without authorization.
• Circumvent any usage limits, access controls, or technical protections.

6. Intellectual property

TechBuild retains all ownership, rights, and interest in the tools, agent skills, software, documentation, branding, and other materials provided through the service. When you purchase or download a skill, you receive a limited, non-exclusive, non-transferable license to use it for your own internal estimating work. You may not redistribute, resell, or publicly share purchased skills.

7. Account and credentials

If you create an account for any TechBuild tool or platform, you are responsible for keeping your credentials secure and for all activity that occurs under your account. Please provide accurate information and keep it updated.

8. Service levels

We aim to keep the service available and reliable, but we do not guarantee uninterrupted or error-free performance. The service is provided "as is" and "as available" to the fullest extent permitted by law. Outputs from AI tools may contain inaccuracies, so you should always review them before relying on them.

9. Suspension and termination

We may suspend or terminate your access to the service if you materially breach these terms, engage in fraudulent or abusive behavior, create a security risk, or fail to make required payment. Upon termination, your right to use the service ends immediately, and any purchased downloadable skills must be deleted from your systems.

10. Limitation of liability

To the fullest extent permitted by law, TechBuild is not liable for indirect, consequential, or special damages (including lost profits, data loss, or goodwill) arising from your use of the service. Our aggregate liability is limited to the amount you paid us in the 12 months preceding the claim. This does not apply to liability that cannot be excluded by law, such as fraud, death, or personal injury.

11. Indemnity

You agree to indemnify and hold TechBuild harmless from any claims arising from your use of the service, your content, or your violation of these terms.

12. Governing law

These terms are governed by the laws of the jurisdiction in which TechBuild operates, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of that jurisdiction.
